According to the United States Bureau of Labor Statistics, in 2021, the Construction Industry accounted for nearly half of all fatal falls, and injuries caused by slips and falls at construction sites. Many of these events were avoidable; but they occur because of construction negligence by a subcontractor, the construction manager, an engineer, an architect, or because of a product defect.
For example, construction workers are often injured by defective powered tools, such as dangerous pneumatic nailers, powered saws, or because they were not provided with proper Personal Protective Equipment (PPE).
For example, over the years, Arthur represented a welder who was given a “flame resistant” shirt but was burned after it caught fire. Arthur represented a worker in a foundry whose foot was burned because he was given defective protective footwear. Arthur represented a shipfitter, a worker who smooths welds during a ship building operation after his coveralls caught fire because they were not safe for the job at hand, referred to as “hot work”. Arthur represented the estate for a man killed when he was not provided the proper PPE at a slaughterhouse.
Arthur has represented Ironworkers who have fallen because of defects in the supplied building materials and because of a manager’s lack of proper safety supervision of work practices and operations. He represented a construction framer who fell because of the use of an improper temporary stairway. He represented a painter who fell because temporary flooring was improperly installed.
Recently, he obtained a multi-million dollar recovery for the family of a man killed in a landfill collapse which resulted because of the failure to use proper safety practices and a proper landfill design.
